Important Legal Notice
Please read this Participant Waiver & Event Disclosure carefully before registering. By checking the acknowledgment box, submitting registration, signing electronically, registering another participant, registering a minor, volunteering, attending, or participating in the Kaiser Permanente Village Run™ 5K, you acknowledge that you have read, understood, and agreed to this waiver and disclosure.
This document affects your legal rights.

1. Definitions
For purposes of this waiver:
“Event” means the Kaiser Permanente Village Run™ 5K and all related activities, including registration, packet pickup, expo activities, warmups, the 5K, youth or family activities, walking, jogging, running, wheeling, volunteering, spectating, parking, vendor areas, sponsor areas, start-line activities, finish-line activities, health fair connections, and all related pre-event, race-day, and post-event programming.
“Participant” means any person who registers for, attends, volunteers at, participates in, or is present at the Event, including adults, minors, spectators, volunteers, vendors, and guests.
“Released Parties” means Village Run™, Rvnner LLC, GivJoi Inc., Kaiser Permanente, City of Vacaville, County of Solano, permitting agencies, public-safety agencies, property owners, event sponsors, presenting partners, nonprofit partners, community partners, vendors, contractors, timing companies, medical personnel, volunteers, race directors, event producers, staff, photographers, media teams, officers, directors, employees, agents, representatives, successors, assigns, and all related or affiliated persons or entities involved with the Event, to the fullest extent permitted by law.

2. Voluntary Participation
I understand that participation in the Event is voluntary. I choose to participate, attend, volunteer, or register myself or another participant with full knowledge that the Event involves physical activity, public gathering, public roads, event equipment, weather exposure, and other risks that cannot be fully eliminated.
I understand that no person is required to participate and that I may choose not to participate if I believe conditions are unsafe or unsuitable for me or for any minor participant I register.

3. Assumption of Risk
I understand that running, walking, jogging, wheeling, volunteering, spectating, and participating in public running events involve inherent and unavoidable risks.
I knowingly and voluntarily assume all risks associated with the Event, including:
Falls, trips, slips, collisions, or contact with other participants, spectators, volunteers, vehicles, bicycles, animals, strollers, mobility devices, signs, cones, barriers, equipment, or objects.
Uneven roads, sidewalks, curbs, gutters, potholes, gravel, dirt, grass, medians, intersections, driveways, parking lots, ramps, temporary course markings, or other course conditions.
Traffic, emergency vehicles, public-road hazards, road closures, detours, crowd movement, or interactions with members of the public.
Heat, cold, wind, rain, sun exposure, humidity, poor air quality, smoke, dehydration, lightning, or other weather and environmental conditions.
Physical exertion, fatigue, overexertion, muscle strains, sprains, fractures, cardiac events, respiratory issues, allergic reactions, fainting, dizziness, illness, or medical emergencies.
Communicable illness or exposure to other participants, volunteers, staff, vendors, spectators, or members of the public.
Property loss, property damage, theft, or damage to personal belongings.
Risks related to parking, arrival, departure, packet pickup, expo areas, sponsor areas, vendor areas, start-line areas, finish-line areas, sidewalks, streets, and all event-related premises.
Risks arising from the acts, omissions, negligence, or conduct of other participants, spectators, volunteers, vendors, contractors, or third parties.
I understand that these risks may result in injury, illness, permanent disability, paralysis, death, emotional distress, economic loss, or property damage.

4. Medical Disclaimer and Fitness to Participate
I certify that I am physically capable of safely participating in the Event. If I am registering a minor participant, I certify that the minor participant is physically capable of safely participating.
I understand that I am responsible for evaluating my own health, fitness, training, medical condition, and ability to participate. I agree not to participate, and not to allow a minor participant to participate, if participation would be unsafe because of a medical condition, injury, illness, disability-related concern, pregnancy-related concern, medication, lack of training, or advice from a healthcare professional.
I understand that Village Run™, Rvnner LLC, GivJoi Inc., Kaiser Permanente, sponsors, volunteers, staff, vendors, and event representatives are not providing medical advice, medical diagnosis, medical screening, or medical treatment through the Event or any Event-related content.
I understand that content, signage, messaging, and communications associated with the Event are for general informational, educational, promotional, or community purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

5. Medical Treatment Consent
I consent to receive first aid, emergency care, medical assistance, transportation, or other treatment deemed necessary or appropriate in the event of injury, illness, accident, or emergency connected to the Event.
I understand that emergency medical assistance may be provided by volunteers, medical personnel, public-safety personnel, third-party providers, or other responders.
I understand that I am responsible for any costs associated with medical treatment, ambulance transport, emergency care, hospital care, follow-up care, or related services, unless otherwise required by law.

6. Release of Liability
In consideration of being allowed to register for, attend, volunteer at, or participate in the Event, I, for myself and for my heirs, executors, administrators, personal representatives, assigns, and anyone entitled to act on my behalf, release, waive, discharge, and agree not to sue the Released Parties for any claims, demands, losses, liabilities, damages, costs, expenses, or causes of action arising out of or related to the Event, to the fullest extent permitted by law.
This release includes claims related to ordinary negligence, inherent risks, accidents, injury, illness, death, property damage, property loss, event modification, event postponement, event cancellation, course conditions, weather conditions, public-road conditions, third-party conduct, volunteer conduct, sponsor areas, vendor areas, packet pickup, expo activities, and all other Event-related activities, to the fullest extent permitted by law.
Nothing in this waiver is intended to release claims that cannot legally be released under applicable law, including claims arising from gross negligence, willful misconduct, fraud, or violation of law.

7. Covenant Not to Sue
I agree not to bring or participate in any lawsuit, claim, demand, or legal action against the Released Parties arising out of or related to my participation in, attendance at, volunteering for, registration for, or presence at the Event, except where such limitation is prohibited by law.

8. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:
My participation in, attendance at, volunteering for, or presence at the Event.
My violation of this waiver or any Event rule.
My negligence, misconduct, or unsafe conduct.
My registration of another participant.
My registration of a minor participant.
Any claim brought by or on behalf of a minor participant I register, to the fullest extent permitted by law.

9. Minor Participants
If I am registering a participant under the age of 18, I certify that I am the parent or legal guardian of the minor participant, or that I have legal authority to complete registration and agree to this waiver on the minor participant’s behalf.
I accept responsibility for the minor participant’s participation, conduct, transportation, safety, and compliance with Event rules before, during, and after the Event.
I understand that minors should be supervised as appropriate and that parents or guardians are responsible for determining whether a minor is capable of safely participating.

10. Event Rules and Participant Conduct
I agree to follow all Event rules, safety instructions, course directions, public-safety instructions, volunteer directions, posted signage, and instructions from Event officials.
I agree to participate in a respectful, safe, and community-minded manner.
I understand that Event officials, volunteers, medical personnel, public-safety personnel, or law enforcement may stop, remove, disqualify, or redirect any participant if they determine, in their judgment, that continued participation may be unsafe, disruptive, unauthorized, or inconsistent with Event rules.
I agree not to interfere with other participants, volunteers, spectators, vendors, public-safety personnel, or members of the public.

11. Participation Language
The Kaiser Permanente Village Run™ 5K is intended to be a community-centered event where participants may run, walk, jog, wheel, move with adaptive support, participate with family members, volunteer, cheer, or gather around the shared purpose of health, community, and youth access.
I understand that participation is not limited to competitive runners. However, I also understand that all participants are responsible for participating safely, staying aware of surroundings, and honoring Event rules and public-safety requirements.

12. Refund Policy
I understand and agree that registration fees are non-refundable.
Registration fees are used to pay for Event expenses that may be incurred before Event day, including permits, insurance, shirts, medals, bibs, timing, supplies, contractors, staffing, marketing, venue costs, signage, equipment, public-safety coordination, course support, and operational costs.
No refund is guaranteed if I am unable to attend, choose not to participate, arrive late, am removed for safety or rule violations, do not complete the Event, or if the Event is modified, delayed, postponed, moved, converted, or canceled.

13. Event Delay, Modification, Postponement, or Cancellation
I understand that the Event may be delayed, modified, postponed, relocated, converted, shortened, suspended, or canceled due to weather, air quality, smoke, heat, lightning, emergency conditions, public-safety concerns, public-health concerns, permitting requirements, road conditions, police, fire, medical requirements, acts of God, government action, venue issues, vendor issues, security concerns, or circumstances beyond the control of the organizers.
I understand that the organizers may change the course, schedule, distance, start time, finish area, expo details, packet pickup details, participant capacity, sponsor activations, or Event format when necessary or appropriate.
If the Event is postponed or modified, the organizers may, at their discretion, provide updated participation options. No refund is guaranteed unless specifically stated in writing by the organizers.

14. Photo, Video, Audio, Name, Likeness, and Results Release
I understand that the Event may be photographed, filmed, livestreamed, recorded, or otherwise documented.
I grant Village Run™, Rvnner LLC, GivJoi Inc., Kaiser Permanente, Event sponsors, Event partners, vendors, photographers, videographers, media teams, and authorized representatives the right to photograph, film, record, publish, display, distribute, edit, and use my name, image, likeness, voice, statements, Event participation, and Event results in any media format.
This permission includes use for Event promotion, websites, social media, advertising, press, public relations, fundraising, sponsor reporting, nonprofit impact reporting, community storytelling, archival purposes, and future Village Run™, GivJoi, Kaiser Permanente, or partner communications, without compensation to me.
I understand that I may appear in individual photos, group photos, crowd footage, finish-line content, expo content, promotional recaps, media coverage, or sponsor/community-impact materials.

15. Nonprofit, Beneficiary, and Tax Clarification
I understand that Village Run™ is an initiative of Rvnner LLC and serves as the Event platform and producer.
I understand that GivJoi Inc. is a registered 501(c)(3) nonprofit organization and serves as the nonprofit impact partner and/or beneficiary connected to the Event.
I understand that Kaiser Permanente may serve as a sponsor, presenting partner, community partner, health-fair partner, or supporter of the Event, but is not responsible for my training, medical readiness, conduct, personal health decisions, or personal property.
I understand that registration fees, merchandise purchases, order bumps, upgrades, and Event participation payments are payments for goods, services, or Event participation and are generally not tax-deductible.
Separate donations made directly to GivJoi Inc. may be tax-deductible to the extent allowed by law. Participants should consult their own tax advisor regarding deductibility.

16. Sponsor, Partner, and Property Owner Limitation Language
I understand that sponsors, presenting partners, health-fair partners, nonprofit partners, property owners, municipalities, vendors, and community partners may support, promote, sponsor, host, provide space for, or collaborate with the Event.
I understand that such involvement does not make those parties responsible for my personal health, training, conduct, decision to participate, personal belongings, travel, transportation, or individual safety decisions.
To the fullest extent permitted by law, I release the Released Parties, including Village Run™, Rvnner LLC, GivJoi Inc., Kaiser Permanente, City of Vacaville, property owners, sponsors, partners, contractors, vendors, volunteers, and staff, from claims arising out of or related to my participation in, attendance at, registration for, volunteering at, or presence at the Event.

17. Personal Property
I understand that I am responsible for my own personal property before, during, and after the Event.
The Released Parties are not responsible for lost, stolen, damaged, misplaced, or unattended property, including bags, wallets, phones, watches, keys, clothing, shoes, medical devices, mobility devices, strollers, bicycles, or vehicles.

18. Communications and Registration Information
I understand that information submitted during registration may be used for Event administration, participant communications, safety updates, packet pickup, timing/results, volunteer coordination, sponsor or partner reporting, nonprofit impact reporting, and future communications related to Village Run™, GivJoi, or related events.
I understand that I may receive emails, texts, or other communications regarding registration, packet pickup, schedule changes, safety notices, weather notices, Event logistics, volunteer opportunities, fundraising opportunities, merchandise, future events, and related community updates.

19. Event Results
If the Event includes timing, scoring, bib tracking, age-group results, or finish-line results, I understand that my name, bib number, age group, gender/category, finish time, placement, or related Event results may be publicly displayed, published, shared, archived, or used for Event purposes.

20. Accessibility and Adaptive Participation
Village Run™ seeks to create a welcoming community experience. Participants who require reasonable accommodations, adaptive participation support, or mobility-related considerations should contact the Event team before Event day when possible.
I understand that course conditions, road conditions, weather, crowd size, public-safety requirements, and permitting requirements may affect participation options. I am responsible for determining whether the Event and course are suitable for my own safe participation.

21. No Guarantee of Event Experience
I understand that Event details may change. Village Run™, Rvnner LLC, GivJoi Inc., Kaiser Permanente, sponsors, partners, and vendors do not guarantee any particular Event experience, course condition, schedule, giveaway, shirt size, medal, vendor, sponsor activation, speaker, expo element, weather condition, finish time, health outcome, personal result, or fundraising outcome.

22. Severability
If any provision of this waiver is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect to the fullest extent permitted by law.

23. Governing Law and Venue
This waiver shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
To the extent permitted by law, any dispute arising out of or related to this waiver or the Event shall be brought in a court of competent jurisdiction located in Solano County, California.

24. Acknowledgment and Electronic Signature

I acknowledge that I have read this Kaiser Permanente Village Run™ 5K Participant Waiver & Event
Disclosure.

I understand its terms.

I understand that I am giving up certain legal rights.

I understand that this waiver includes an assumption of risk, release of liability, refund policy, medical disclaimer, media release, nonprofit clarification, and Event modification policy.

I agree to this waiver freely and voluntarily.

By checking the acknowledgment box, submitting registration, signing electronically, registering another participant, registering a minor participant, volunteering, attending, or participating in the Event, I agree to be bound by this Kaiser Permanente Village Run™ 5K Participant Waiver & Event Disclosure.
